Chirp Mobile Terms of Service

1. Welcome to Chirp’s SMS Service.

Thank you for using Chirp! If you have signed up for the mobile message service (the "SMS Service") offered by Get Chirp, LLC (collectively, "Chirp", "we", or "us"), these mobile terms of service ("Mobile Terms") apply to you.

By agreeing to these Mobile Terms, you must be at least 18 years of age. The SMS Service is not intended for those under the age of 18. If you are accessing our SMS Service on behalf of someone else, you acknowledge that you have their permission to do so.

The SMS Service is provided by a third-party technology platform, Braze, Inc. Your use of the SMS Service constitutes your agreement to these Mobile Terms, which supplement Chirp’s Terms of Service and Privacy Policy.

These Terms, along with any referenced policies or other documents linked here or elsewhere on Chirp’s websites, applications, and services, including but not limited to the chirp.me website and associated Creator Pages ("Websites"), form a binding legal agreement between you and Chirp. If you do not agree to these Mobile Terms, you should unsubscribe from the SMS Service immediately.

2. Changes to the Mobile Terms and SMS Service.

We may modify or cancel the SMS Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time to address changes made to the Braze platform, among other things. Your continued use of the SMS Service following the effective date of any changes means that you legally accept the changes.

3. Consent to Receive Messages; Voluntary Participation.

By consenting to the SMS Service, you agree to receive recurring SMS/text messages from and on behalf of Chirp through your wireless provider to the mobile number you provided to us. If your mobile number is registered on any state or federal Do Not Call list, but you then opt in to our SMS Service, you are agreeing to receive text messages, which will override your prior decision to be placed on the Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (such as order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers.

You do not have to sign up for the SMS Service to make any purchases, and your consent is not a condition of any purchase with Chirp. Your participation in the SMS Service is completely voluntary.

4. Opt Out

You may opt out of the SMS Service at any time. Text the single keyword command STOP to Chirp’s 10-digit phone number or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Chirp mobile message programs and wish to cancel, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms, except where applicable law requires otherwise.

5. Wireless Charges May Apply.

We do not charge for the SMS Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

6. Support.

For support with the SMS Service, just text HELP to Chirp’s 10-digit phone number or email [email protected].

We may change the short code or telephone number we use to operate the SMS Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests that you send to a short code or telephone number we have changed may not be received. In that case, we will not be responsible for honoring requests made in messages to an incorrect number.

The wireless carriers supported by the SMS Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for SMS Service with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the SMS Service, any errors in such information, and/or any action you may or may not take in reliance on the information or SMS Service.
